Decide on the name of the entity
be sure to check both the URL and trademark availability
Decide on the entity type
Usually this will be a corporation or a limited liability company
Decide on the tax structure of your business
If you wanted to be taxed as a C-corporation, S-corporation, partnership)
Decide on the state of formation
Most likely this wil be Delaware or your home state
Have the proper documents filed with the Office of the Secretary of State in the applicable state
Includes your (certificate (or articles) of incorporation or formation/organization whichever applicable
Have the remaining documents prepared
Includes bylaws, founders documents, operating agreement, as applicable)
Obtain a federal Employer Identification Number from the IRS; and
Finally, Set up a company bank account
And that’s it! Congrats, you’re ready to go!
